These Terms of Service ("Terms") govern your access to and use of the TaxHoliday.app API, website, and the TaxHoliday Shopify application (collectively, the "Service"), operated by TaxHoliday.app ("we", "us", "our"). By installing the app, creating an account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service provides sales-tax-holiday and sales-tax-rate data via an API, a website, and a Shopify application that can display a tax-holiday badge at checkout. Features may change, improve, or be discontinued over time.
To use the API you receive an API key, which is provisioned to you directly or, for Shopify merchants, automatically when you subscribe through the app. You are responsible for keeping your credentials secure and for all activity under your account. Do not share your API key or resell access without our written permission.
You agree not to: exceed your plan's rate limits or attempt to circumvent them; use the Service to build a competing dataset or to scrape, resell, or redistribute our data in bulk; interfere with or disrupt the Service; or use the Service for any unlawful purpose.
We compile tax-holiday information from official government sources and retain screenshot evidence and a record of changes. We work to keep the data accurate and current, but tax laws change, government sources can contain errors or be published late, and no data source is perfect. We do not warrant that the data is complete, accurate, or up to date at any given moment.
The Service is provided for informational purposes only and does not constitute tax, legal, or accounting advice. You are solely responsible for charging, collecting, and remitting the correct sales tax, for complying with all applicable laws, and for any representations (including "tax free" or savings messaging) shown to your customers. You should verify tax treatment with a qualified professional and with the relevant taxing authority.
THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
To the maximum extent permitted by law, TaxHoliday.app and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, uncollected or over-collected tax, penalties, or lost data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three (3) months preceding the claim.
The Service, including its software, website, and compiled data, is owned by TaxHoliday.app and protected by applicable laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan.
Our handling of data is described in our Privacy Policy, which is incorporated into these Terms. In short, we process only a shipping postal code and product category to determine tax-holiday eligibility and do not store customer personal data.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to us, other users, or third parties. Upon termination, your right to use the Service ends.
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and your continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of the United States and the state in which the operator of TaxHoliday.app resides, without regard to conflict-of-law principles.
